ഇസ്‌ലാമിക നിയമം അനുസരിച്ച് ഒരു ഇസ്‌ലാമികരാഷ്ട്രത്തിൽ സ്ഥിരവാസികളായ അമുസ്‌ലിംകൾ ( ദിമ്മി ) വർഷത്തിൽ നൽകേണ്ടിവന്നിരുന്ന നികുതിയാണ് ജിസ്‌യ (കപ്പം) ( അറബി: جِزْيَة ; [d͡ʒizjah] )[1][2][3] . ദിമ്മി സമൂഹത്തിലെ സ്വതന്ത്രരും ബുദ്ധിസ്ഥിരതയുമുള്ള എല്ലാ പുരുഷന്മാർക്കും ജിസ്‌യ നൽകൽ നിർബന്ധമാണെന്ന് പണ്ഡിതന്മാർ അഭിപ്രായപ്പെടുന്നുണ്ട്[4]. എന്നാൽ അവരിലെ സ്ത്രീകൾ, കുട്ടികൾ, വയോധികർ, വികലാംഗർ, സ്ഥിരരോഗികൾ, ബുദ്ധിസ്ഥിരതയില്ലാത്തവർ, സന്ന്യാസിമാർ, അടിമകൾ എന്നിവരൊക്കെ ജിസ്‌യയിൽ നിന്ന് ഒഴിവാക്കപ്പെട്ടുവന്നു[5][6][7][8][9]. പ്രദേശത്ത് താൽക്കാലികമായി തങ്ങുന്നവർ[5][10], രാഷ്ട്രത്തിന്റെ സൈനികസേവനത്തിൽ പങ്കാളികളാകുന്നവർ[1][6][11][12][13] ദരിദ്രർ എന്നിവരെയും ജിസ്‌യയിൽ നിന്ന് ഒഴിവാക്കപ്പെട്ടു[14][15][6][16][17]. ഇസ്‌ലാമിക നിയമമനുസരിച്ച് ദിമ്മികളിലെ വയോധികർ, വികലാംഗർ എന്നിവർക്കൊക്കെ പെൻഷൻ നൽകൽ ഭരണകൂടത്തിന്റെ ബാധ്യതയാണ്.

ഈ നികുതിയ്ക്ക് പകരമായി അമുസ്ലിംകൾക്ക് അവരുടെ മതവിശ്വാസം തുടരുകയും സാമൂഹികമായ സ്വയംഭരണം ഒരുപരിധിവരെ അനുഭവിക്കുകയും ബാഹ്യ ആക്രമണങ്ങളിൽ നിന്ന് മുസ്ലിം ഭരണകൂടത്തിന്റെ സംരക്ഷണം അ‌നുഭവിക്കുകയും ചെയ്യാനാകുമായിരുന്നു. നിർബന്ധിത സൈനിക സേവനവും മുസ്ലിം പൗരന്മാർ ന‌ൽകേണ്ടിയിരുന്ന സക്കാത്ത് എന്ന നികുതിയും ഇവർക്ക് ഒഴിവാക്കി നൽകിയിരുന്നു[18][19].

ഖുർആനും ഹദീസുകളും ജിസിയയെ പരാമർശിക്കുന്നുണ്ടെങ്കിലും അതിന്റെ തുകയോ നിരക്കോ നിശ്ചയിച്ചിട്ടില്ല.[20]. എന്നിരുന്നാലും, ആദ്യകാല മുസ്‌ലിം ഭരണാധികാരികൾ ബൈസന്റൈൻ, സസാനിയൻ സാമ്രാജ്യങ്ങൾ പോലുള്ള കീഴടക്കിയ ഭൂമികളുടെ മുൻ ഭരണാധികാരികളുടെ കീഴിൽ സ്ഥാപിതമായ നിലവിലുള്ള നികുതി വ്യവസ്ഥകളും കപ്പവും സ്വീകരിച്ചുവെന്ന് പണ്ഡിതന്മാർ പ്രധാനമായും സമ്മതിക്കുന്നു.[10][21][22][23][24]

മുസ്ലിം ഭരണാധികാരികളുടെ കാഴ്ചപ്പാടിൽ അമുസ്ലിംകൾ രാജ്യത്തിന് കീഴ്പ്പെട്ടിരിക്കുന്നു എന്നതിനും നാട്ടിലെ നിയമങ്ങൾ അനുസരിക്കുന്നു എന്നതിനുമുള്ള തെളിവായിരുന്നു ഈ നികുതി[അവലംബം ആവശ്യമാണ്]. പത്തൊൻപതാം നൂറ്റാണ്ടുവരെ പേർഷ്യയിലും ചില വടക്കൻ ആഫ്രിക്കൻ രാജ്യങ്ങളിലും ജസിയ നിലവിലുണ്ടായിരുന്നു. ഇരുപതാം നൂറ്റാണ്ടിൽ ഇത് ഏകദേശം പൂർണ്ണമായി അപ്രത്യക്ഷമായി.[25] ഇസ്ലാമിക രാജ്യത്തെ ഭരണകൂടങ്ങൾ ഈ നികുതി ഇപ്പോൾ പിരിക്കുന്നില്ല.[26] ഐ.എസ്.ഐ.എസ്., താലിബാൻ മുതലായ വിഭാഗങ്ങൾ ഈ നികുതി ഇവരുടെ നിയന്ത്രണത്തിലുള്ള പ്രദേശങ്ങളിൽ പിരിക്കാറുണ്ട്.[27] ഇരുപത്തൊന്നാം നൂറ്റാണ്ടിൽ ഈ നികുതി നിയമത്തിനു മുന്നിലുള്ള തുല്യത, പൗരാവകാശങ്ങൾ മുതലായ ആശയങ്ങൾക്ക് കടകവിരുദ്ധമായാണ് കണക്കാക്കപ്പെടുന്നത്.[25]

ഒരു മുസ്ലിമിന്റെ വരവും സ്വത്തും നിസാബിൽ (ഒരു നിശ്ചിത അളവിൽ) കവിഞ്ഞാൽ സക്കാത്ത് നിർബന്ധമാണ്.[30] ജസിയ സൈനികസേവനത്തിന് ശേഷിയുള്ള എല്ലാ അമുസ്ലിം പുരുഷന്മാർക്കും നിർബന്ധമാണ്, അവരുടെ വരവിലോ സ്വത്തിന്റെ അളവിലോ അല്ല ഇത് നിർണ്ണയിക്കപ്പെടുന്നത്.[31]
ഒരു ചന്ദ്രവർഷത്തിനിടയിൽ തുടർച്ചയായി ഉള്ള വരവിനോ കൈവശം വെച്ചനുഭവിക്കുന്ന സ്വത്തിനോ - നിസാബിൽ കവിയുന്ന തുകയ്ക്ക വിളവെടുക്കുന്ന (വരവിന്റെ) തീയതിയിൽ ഒടുക്കണം.[32] എല്ലാ സ്വത്തിലും വരവിലും എല്ലാ വർഷവും അല്ലെങ്കിൽ വാർഷിക-പാദ വ്യവസ്ഥിതിയിൽ നിസാബിന്റെ അടിസ്ഥാനമില്ലാതെ ഒടുക്കണം.[29]. പ്രവാചകന്റെ സമയം വരേയും, ഒരു സ്വർണ്ണ ദിനാറും 12 ദിർഹവും; അദ്ദേഹത്തിനു ശേഷം, മിക്കവാരും എല്ലാ സ്വത്തിന്റേയും/വില്പനയുടേയും 20% എങ്കിലും അല്ലെങ്കിൽ അതിൽ കൂടുതലുമായുള്ള മൂന്നു വിഭാഗങ്ങളായി നിശ്ചയിക്കപ്പെട്ടു.[33] ഇതിന്റെ ഏറ്റവും കൂടിയ നിരക്കായി, ഇസ്ലാമിക സാമ്രാജ്യങ്ങളിലുള്ള കൃഷിയിടങ്ങളിലെ വാർഷിക ഉല്പാദനത്തിന്റെ 33% മുതൽ 80% വരെയും ജസിയ പിരിച്ചെടുത്തിരുന്നു.[34][അവലംബം ആവശ്യമാണ്]
സക്കാത്ത് ശരിഅത്തിൽ പ്രതിപാദിക്കപ്പെട്ടതാണ്.[29] ശരിഅത്തിൽ പ്രതിപാദിക്കപ്പെട്ടിട്ടില്ല;[35][36]
സ്വത്തിന്റെ ഉടമസ്ഥ/ൻ മാത്രം ഒടുക്കിയാൽ മതി.[37] മുതിർന്ന, ശാരീരിക/കായിക ക്ഷമതയുള്ള, സൈനിക സേവനത്തിനാവശ്യമായ വയസ്സിലുള്ള എല്ലാ അംഗവും ഒടുക്കണം.[38]
സക്കാത്ത് കൊടുക്കാതിരിക്കുന്നത് ചില രാജ്യങ്ങളിൽ പിഴയുളവാക്കുന്നതും ചിലപ്പോൾ ശിക്ഷാർഹവും ആയ കുറ്റമാണ്. ചിലയിടങ്ങളിൽ ഇളവുകൾ അനുവദനീയമായിരുന്നു.[39][40] ജസിയ കൊടുക്കാതിരിക്കുക എന്നത് അമുസ്ലിംകൾ ചെയ്യുന്ന വളരെ വലിയ കുറ്റമായിരുന്നു. ഇതിന് കുടുംബത്തിന്റെ കൂട്ട തടങ്കലിനും അടിമപ്പെടുത്തലിനും അടക്കം കനത്ത ശിക്ഷ കൊടുത്തിരുന്നു.[41] അടിമയാക്കപ്പെടുന്ന കുടുംബത്തിലെ സ്ത്രീകളും പെൺകുട്ടികളും ഏതെങ്കിലും മുസ്ലിം ഉടമയുടെ സ്വത്തായിത്തീരുകയും അയാളുടെ വീട്ടു വേലക്കാരും അയാളുടെ സ്വകാര്യ വേശ്യയും ആയിത്തീരുമായിരുന്നു. കുടുംബമടക്കം ഇസ്ലാമായി മത പരിവർത്തനം നടത്തുന്നത് ചില സാഹചര്യങ്ങളിൽ ശിക്ഷയിൽ നിന്നും രക്ഷപെടാൻ ഉപകരിച്ചിരുന്നു.[42]
ദൈവത്തിന്റെ സന്തോഷത്തിനും പ്രീതിക്കുമായി നൽകിയിരുന്നു.[43] ആത്മനിന്ദയോടെയും തന്നെത്തന്നെ ചെറുതാക്കിക്കൊണ്ട് മറ്റുള്ളവരെ സന്തോഷിപ്പിക്കാനായി[44][45]
