സോഫ്റ്റ്‍വെയറിന്റെ പ്രസാധകൻ അല്ലെങ്കിൽ മറ്റൊരു വ്യക്തിക്ക് ബൌദ്ധിക സ്വത്തവകാശം കൈവശം വച്ചിരിക്കുന്ന സ്വതന്ത്രമല്ലാത്ത കമ്പ്യൂട്ടർ സോഫ്റ്റ്‍വെയറാണ് കുത്തക സോഫ്റ്റ്‍വെയറുകൾ മാത്രമല്ല ക്ലോസ്ഡ്-സോഴ്സ് സോഫ്റ്റ്‍വെയറുകൾ എന്നും അറിയപ്പെടുന്നു. സാധാരണയായി സോഴ്സ് കോഡിന്റെ പകർപ്പവകാശം സ്വന്തമാക്കിവെക്കുന്നതായിരിക്കും.എന്നാൽ ചിലപ്പോൾ പേറ്റന്റ് അവകാശങ്ങളും ഉണ്ടായിരിക്കും.

സോഫ്റ്റ്‍വെയർ കുത്തകയാകുന്നു[തിരുത്തുക]

1960 കളുടെ പകുതിവരെ കമ്പ്യൂട്ടറുകൾ,  വലിയതും ചെലവേറിയതുമായ മെയിൻഫ്രെയിം കമ്പ്യൂട്ടറുകൾ [1][2]1969 വരെ സേവനങ്ങളും  ലഭ്യമായ എല്ലാ സോഫ്റ്റ്‍വെയറുകളും നിർമ്മാതാക്കൾ പ്രത്യേകം ചാർജ് ഇല്ലാതെ വിതരണം ചെയ്തിരുന്നു. കമ്പ്യൂട്ടർ നിർമാതാക്കൾ ഇൻസ്റ്റാൾ ചെയ്ത സോഫ്റ്റ്‍വെയറിന്റെ സോഴ്സ്കോഡും നൽകിയിരുന്നു. സോഫ്റ്റ്‍വെയർ നിർമിച്ച ഉപഭോക്താക്കൾ മറ്റുള്ളവർക്ക് പണം വാങ്ങാതെ ലഭ്യമാക്കിയിരുന്നു.[3] ക്ലോസ്ഡ് സോഴ്സ് എന്നാൽ സോഴ്സ്‍കോഡ് പബ്ലിഷ് ചെയ്യാത്ത കമ്പ്യൂട്ടർ പ്രോഗ്രാമുകളാണ്. അത് നിർമിച്ച സംഘടനയ്ക്ക് മാത്രമേ ആ പ്രോഗ്രാം കാണാനോ തിരുത്താനോ കഴിയൂ.

1969 ൽ ഐബിഎം ന് എതിരെ ഉണ്ടായ ആന്റിട്രസ്റ്റ് ലോസ്യൂട്ട് ഒരു വ്യവസായിക മാറ്റത്തിലേക്ക് വഴിതെളിച്ചു. അങ്ങനെ ഹാർഡ്‍വെയറും സോഫ്റ്റ്‍വെയറും വേർത്തിരിച്ചുകൊണ്ട് മെയിൻഫ്രെയിം സോഫ്റ്റ്‍വെയറിന് പ്രത്യേകമായി ചാർജ് ചെയ്യുന്നതിലേക്ക് നയിച്ചു.[4][5][6]

1976 ൽ ബിൽഗേറ്റ്സ് തയ്യാറാക്കിയ കമ്പ്യൂട്ടർ ഹോബിസിസ്റ്റുകൾക്കൊരു തുറന്ന കത്തിൽ  കമ്പൂട്ടർ ഹോബിസിസ്റ്റുകൾ സോഫ്റ്റ്‍വെയർ പകർപ്പാവകാശം ലംഘിക്കുന്നതായി ചൂണ്ടിക്കാണിച്ചു. പ്രത്യേകിച്ചും മൈക്രോസോഫ്റ്റിന്റെ ആൾട്ടയർ ബേസിക്ക് ഇന്റർപ്രെറ്ററിൽ. മികച്ച സോഫ്റ്റ്‍വെയർ ഉണ്ടാക്കുന്നതിനുള്ള  കഴിവ് അവർ സോഫ്റ്റ്‍വെയർ മോഷ്ടിക്കുന്നതുകൊണ്ട് തടസ്സപ്പെടുന്നുവെന്നും അദ്ദേഹം ഓർമപ്പെടുത്തി.[7]

1976ലെ യുഎസ് കോപിറൈറ്റ് ആക്ടിന്റെ ഭാഗം കൂടിയായാണ് സോഫ്റ്റ്‍വെയറിന്റെ നിയമങ്ങൾ ഭേദഗതി ചെയ്തത് എന്ന് ബ്രൂസ്റ്റർ കാലെ   നിരീക്ഷിച്ചു.[8]

1960-കളുടെ അവസാനം വരെ കമ്പ്യൂട്ടറുകൾ - വലുതും ചെലവേറിയതുമായ മെയിൻഫ്രെയിം കമ്പ്യൂട്ടറുകൾ, പ്രത്യേകം എയർകണ്ടീഷൻ ചെയ്ത കമ്പ്യൂട്ടർ മുറികളിലെ മെഷീനുകൾ - സാധാരണയായി വിൽക്കുന്നതിന് പകരം ഉപഭോക്താക്കൾക്ക് പാട്ടത്തിന് നൽകിയിരുന്നു.[1] [9]സേവനവും ലഭ്യമായ എല്ലാ സോഫ്‌റ്റ്‌വെയറുകളും 1969 വരെ നിർമ്മാതാക്കൾ പ്രത്യേകം നിരക്കില്ലാതെ വിതരണം ചെയ്‌തിരുന്നു. കമ്പ്യൂട്ടർ വെണ്ടർമാർ സാധാരണയായി ഉപഭോക്താക്കൾക്ക് ഇൻസ്റ്റാൾ ചെയ്ത സോഫ്റ്റ്‌വെയറിന്റെ സോഴ്‌സ് കോഡ് നൽകിയിരുന്നു.[10] ക്ലോസ്ഡ് സോഴ്‌സ് എന്നാൽ ലൈസൻസികൾക്ക് മാത്രം ലഭ്യമായതും സോഴ്‌സ് കോഡ് പബ്ലിഷ് ചെയ്യാത്ത കമ്പ്യൂട്ടർ പ്രോഗ്രാമുകളാണ്. ഇത് വികസിപ്പിച്ച ഓർഗനൈസേഷനും സോഫ്‌റ്റ്‌വെയർ ഉപയോഗിക്കാൻ ലൈസൻസുള്ളവർക്കും മാത്രമേ എഡിറ്റ് ചെയ്യാൻ സാധിക്കൂ.
