ന്യൂനപക്ഷാവകാശങ്ങൾ
ന്യൂനപക്ഷ അവകാശങ്ങൾ എന്ന സംജ്ഞ രണ്ട് വ്യത്യസ്ത സങ്കല്പങ്ങളിലധിഷ്ഠിതമാണ്. വംശീയവും വർഗ്ഗപരവും മതപരവും, ഭാഷാപരവും ലിംഗപരവുമായ വിഭാങ്ങളിലെ ന്യൂനപക്ഷ അംഗങ്ങളുടെ സാധാരണ വ്യക്തി അവകാശങ്ങൾക്ക് ബാധകമാവുന്നതാണ് ഒന്നാമത്തേത്. രണ്ടാമത്തേത്, ന്യൂനപക്ഷ വിഭാഗങ്ങൾക്ക് അനുവദിച്ചു നൽകപ്പെട്ടിട്ടുള്ള കൂട്ടായ അവകാശങ്ങളാണ്. ഭൂരിപക്ഷ അഭിപ്രായത്തിന്റെ ഭാഗമല്ലാത്ത ഏതെങ്കിലും ആളുകളുടെ വ്യക്തിപരമായ അവകാശങ്ങളെ സംബന്ധിച്ചും ഈ പദം ബാധകമാണ്.
ന്യൂനപക്ഷ വിഭാഗങ്ങളിൽ അംഗമായതിന്റെ പേരിൽ ഒരു വ്യക്തിയുടെ അവകാശങ്ങൾ നിഷേധിക്കപ്പെടാതിരിക്കാൻ പൗരാവകാശ പ്രസ്ഥാനങ്ങൾ പ്രത്യേക ശ്രദ്ധവെക്കുന്നു. ന്യൂനപക്ഷ അവകാശങ്ങൾ സവിശേഷമായി ഉള്ള നിരവധി രാഷ്ട്രീയ സ്ഥാപനങ്ങളുണ്ട്. പ്രത്യേക ക്വാട്ടകൾ വാഗ്ദാന ചെയ്യുന്നതിലൂടെ,ഭരണ രംഗത്ത് ന്യൂനപക്ഷ പ്രാതിനിധ്യം ഉറപ്പ് നൽകുന്നതിലൂടെയെല്ലാം ഇതു കാണാനാവും.
ന്യൂനപക്ഷാവകാശങ്ങൾ ദേശീയ ,അന്തർദേശീയ നിയമങ്ങളിൽ [തിരുത്തുക]
1849 ൽ ഹംഗേറിയൻ ഡയറ്റാണ് ആദ്യമായി ന്യൂനപക്ഷ അവകാശങ്ങൾ രൂപവത്കരിക്കുന്നത്. വംശപരവും, മതപരവും, ഭാഷാപരവുമായ ന്യൂനപക്ഷങ്ങളുട അവകാശങ്ങൾ, അന്തർദേശീയ മനുഷ്യാവകാശ നിയമങ്ങളുടെ അവിഭാജ്യ ഘടകമാണ്. വനിതകളുടേയും കുട്ടികളുടേയും അവകാശങ്ങൾ, അഭയാർഥികളുടെ അവകാശങ്ങൾ എന്നിവപോലെ തന്നെ ന്യൂനപക്ഷ അവകാശങ്ങളും നിയമപരമായ ചട്ടക്കൂടിനുള്ളിൽ രൂപകല്പന ചെയ്ത ഒന്നാണ്. അതിലൂടെ പ്രാന്തവൽകരിക്കപ്പെട്ടവരും മുഖ്യധാരയിൽ നിന്ന് പുറംതള്ളപ്പെട്ടവരുമായ വിഭാഗങ്ങൾക്ക് സമത്വവും അടിച്ചമർത്തലിൽ നിന്നുള്ള സംരക്ഷണവും ലഭിക്കുന്നു. ആദ്യത്തെ യുദ്ധാനന്തര അന്തർദേശീയ ന്യൂനപക്ഷ അവകാശസംരക്ഷണ ഉടമ്പടിയായ "നരഹത്യ കുറ്റത്തെ തടയുന്നതിനും ശിക്ഷിക്കുന്നതിനമ്മുള്ള ഐക്യരാഷ്ട്ര സഭ ഉടമ്പടി" (U.N. Convention on the Prevention and Punishment of the Crime of Genocide),ന്യൂനപക്ഷങ്ങളുടെ അസ്തിത്വത്തെ തന്നെ ചോദ്യം ചെയ്യുന്ന ഭീഷണിയിൽ നിന്ന് സംരക്ഷണം നൽകുന്നതിനായി രൂപവത്കരിച്ചിട്ടുള്ളതാണ് മനുഷ്യാവകാശ മാനദണ്ഡങ്ങൾ വെച്ച് തുടർന്ന് വ്യവഛേദിക്കപ്പെട്ട ന്യൂനപക്ഷ നിയമങ്ങൾ ഇവയാണ്. രാഷ്ട്രീയ -പൗരാവകാശങ്ങൾക്കായുള്ള അന്തർദേശീയ ഉടമ്പടി -ആർട്ടിക്കിൾ 27-(International Covenant on Civil and Political Rights), ദേശീയവും,വംശീയവും,മതപരവും,ഭാഷാപരവുമായ ന്യൂനപക്ഷങ്ങൾക്ക് വേണ്ടിയുള്ള അവകാശ പ്രഖ്യാപനം(United Nations Declaration on the Rights of Persons Belonging to National or Ethnic, Religious and Linguistic Minorities), യൂറോപ്പ് ഉടമ്പടികളുടെ രണ്ട് കൗൺസിലുകൾ (the Framework Convention for the Protection of National Minorities and the European Charter for Regional or Minority Languages),ഒ.എസ്.സി.ഇ. കോപ്പൻ ഹേഗൻ ഡോക്യുമെൻഡ് 1990. അസ്തിത്വ സംരക്ഷണം, അടിച്ചമർത്തലിൽ നിന്നും വിവേചനങ്ങളിൽ നിന്നുമുള്ള സംരക്ഷണം, സ്വത്വ സംരക്ഷണവും അതിനെ ഉയർത്തികൊണ്ടുവരൽ, രാഷ്ട്രീയ ജീവിതത്തിലുള്ള പങ്കാളിത്തം എന്നിവ ന്യൂനപക്ഷ അവകാശങ്ങൾ ഉൾകൊള്ളുന്നു. ന്യൂനപക്ഷ അവകാശങ്ങൾ സംരക്ഷിക്കുന്നതിനായി വിവിധ രാജ്യങ്ങളിൽ പ്രത്യേകമായ നിയമങ്ങളും/കമ്മീഷനുകളും അതല്ലങ്കിൽ ഓംബുഡ്സ്മാൻ സ്ഥാപനങ്ങളുമുണ്ട്.(ഉദാഹരണമായി ഇന്ത്യയിൽ ന്യൂനപക്ഷ കമ്മീഷനും ഭരണതലത്തിൽ ന്യൂനപക്ഷ കാര്യ മന്ത്രാലയവുമുണ്ട്) പ്രാഥമികമായി ഐക്യരാഷ്ട്ര സഭ തദ്ദേശിയരായ ജനതയെ ന്യൂനപക്ഷ വിഭാഗങ്ങളുടെ ഉപവർഗ്ഗമായാണ് കണ്ടെതെങ്കിലും അവർക്കായി പ്രത്യേകം നിയോഗിതമായ ചില അന്തർദേശീയ നിയമങ്ങൾ വികസിച്ചു വരികയുണ്ടായി. അന്തർദേശീയ തൊഴിൽ സംഘടനയുടെ(International Labour Organization-ILO) 169 ആം ഉടമ്പടിയും ,14 സെപ്റ്റംബർ 2007 ന് നിലവിൽ വന്ന ഐക്യരാഷട്ര സഭയുടെ തദ്ദേശിയ ജനങ്ങൾക്കായുള്ള അവകാശ പ്രഖ്യാപനം(UN Declaration on the Rights of Indigenous Peoples)ഇപ്രകാരം വികസിച്ചു വന്നതാണ്. ലിംഗപരമായ ന്യൂനപക്ഷങ്ങളുടെ അവകാശങ്ങളെ അന്തർദേശീയ മനുഷ്യാവകാശ നിയമങ്ങളിൽ വ്യവഛേദിക്കാനുള്ള ശ്രമം ഐക്യരാഷ്ട്ര സഭയിലെ അംഗരാജ്യങ്ങളിൽ നിന്ന് കടുത്ത എതിർപ്പാണുണ്ടാക്കിയത്
